CONTEST REGULATIONS

CONTEST 'LDT01'

NO PURCHASE REQUIRED OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT HELP OR IMPROVE YOUR CHANCES OF WINNING.

DO NOT PARTICIPATE IF YOU DO NOT WISH TO BE BOUND BY THE RULES BELOW. BY ENTERING THIS CONTEST, YOU ARE INDICATING THAT YOU HAVE READ THESE RULES, WHICH ARE A CONTRACT, AND THAT YOU AGREE TO ABIDE BY THEM.

ORGANIZER − The “LDT01” giveaway is organized and administered by Équipe de Dérapage Légaré inc.

CONTEST PERIOD − The Contest begins at 12:01 a.m. Eastern Standard Time on May 1, 2024 and ends at 11:59 p.m. EST on July 2, 2024. The clock used by the Contest Organizer is the official clock to determine the date and the time of receipt of an Entry.

ELIGIBILITY − The Contest is open only to legal residents of Canada, holders of a driver's license and having reached the legal age of majority in their jurisdiction of residence on the date of their Participation in the Contest. Excluded are employees of the Competition Organizer, their subsidiaries, their advertising partners, their Internet agencies, as well as each of their respective managers, agents and representatives and members of their immediate family (legal or de facto spouse, parent, child, brother and grandparent) and/or those living under the same roof. The Contest is void where prohibited by law. All federal, state, and local laws and regulations apply. By participating in the Competition, participants agree to be bound by these Rules. Winning the Prize is conditional upon compliance with all requirements set out in these Rules.

HOW TO PARTICIPATE − No purchase necessary.

There are 2 (two) ways to enter the Competition for a chance to win the Prize (as described below):

ENTRANCE BY A PURCHASE − During the Contest Period, eligible participants will receive one (1) Entry for each Canadian dollar ($1.00) spent on eligible purchases of products and items from the Contest Organizer made:

For purchases in participating establishments of the Competition Organizer, participants will receive a coupon with their receipt including a unique PIN corresponding to the number of Entries received (hereinafter called the “unique PIN”) and must visit the Site Web in order to access the Competition registration page, complete all the mandatory fields of the registration form (hereinafter called the “Registration Form”), including their last name, first name, date of birth, code postal address, email address, telephone number with area code, unique PIN and confirm that they have read, understood and accepted the Regulations.

The number of Entries per purchase you receive will be based on the sale price of your qualifying purchase (excluding sales taxes and shipping charges, if applicable) and will be rounded up to the nearest Canadian dollar (1.00 $) nearest. If a purchase is returned before the Prize drawing, the Entries associated with that purchase will be void. Eligible participants will receive one (1) Entry for each Canadian dollar ($1.00) spent on the purchase of a gift card, based on the value of the gift card purchased, for example, a gift card purchase. gift of fifty dollars ($50.00) will generate fifty (50) Entries. Purchases made using a gift card are not eligible to receive Entries; however, a purchase that exceeds the value of the gift card will be eligible to receive Entries based on the balance due after the gift card is applied to the item purchased (for example, a qualifying purchase of one hundred dollars (100 .00) using a fifty dollar ($50.00) gift card will generate fifty (50) Entries - sales tax, shipping, etc. do not count toward Entries). All purchases are subject to the Contest Organizer’s return policy. Your purchase transaction must be received by the Contest End Date and must include your consent to be entered to be eligible to receive Entries via purchase in this Contest. No limit on the number of Entries per purchase received and participant consent. During the Competition Period, the participant will also have the opportunity to sign up to receive other email communications from the Competition Organizer. Entrants are not required to register for this service to participate in this Contest, and registering will not increase your chances of winning. If a participant chooses to register, he or she grants the Contest Organizer permission to send him or her future communications regarding services, rewards, offers, promotions or other messages related to the services and products of the Competition Organizer, from which the participant can unsubscribe at any time. The participant's online consent is required to participate through an Entry by Purchase.

ENTRY MULTIPLIER − Throughout the Competition Period, the Competition Organizer may announce opportunities to automatically multiply the number of Entries per purchase, for example, (2X), (5X), (10X), (20X) and (30X) (each hereinafter referred to as a “Multiplier”). Where a Multiplier is offered, Entries will be multiplied by the applicable Multiplier. For example, a purchase of sixty dollars ($60.00) during a 10X Multiplier offer will earn six hundred (600) Entries (60x10=600).


No-purchase Entries (as defined below) are not subject to Multipliers. However, where a Multiplier is offered, No Purchase Entries will receive two hundred (200) Entries. Add the word “LIMITED,” handwritten in the bottom left corner of the envelope, and receive one hundred (100) additional Entries.

The period and duration of a Multiplier will be determined exclusively by the Competition Organizer and will be announced by the Competition Organizer on its Website and/or social media pages.

BONUS ENTRIES − Throughout the Competition Period, the Competition Organizer may announce opportunities to win Bonus Purchase Entries, for online or in-store purchases (hereinafter referred to as a “Bonus”). Example: Win fifteen (15) Bonus Entries with a purchase of thirty dollars ($30.00) at forty-nine dollars and ninety-nine cents ($49.99), twenty-five (25) Bonus Entries with a purchase of fifty dollars ($50.00) to ninety-nine dollars and ninety-nine cents ($99.99) and fifty (50) Bonus Entries for each purchase over one hundred dollars ($100.00). For example, a purchase of sixty dollars ($60.00) during such Bonus will earn eighty-five (85) Entries (60+25=85).


To receive additional Bonus Entries without making a purchase, follow the instructions for No Purchase Entries below. For a Bonus, handwrite the word “BONUS” in the lower right corner of the envelope. Your No-Purchase Entry must be postmarked by the date a Bonus is offered and must be received within five (5) days of the Bonus deadline. If a Bonus ends on a Sunday or federal holiday, the No Purchase Entry must be postmarked the next business day and received within five (5) days of the Bonus deadline.

The period and duration of a Bonus will be determined exclusively by the Competition Organizer and will be announced by the Competition Organizer on its Website and/or social media pages.

ENTRY WITHOUT PURCHASE − To receive sixty (60) Entries without making a purchase or payment of any kind, on a piece of 3" x 5" paper, write by hand your first and full name, address, city, province, postal code, date of birth (dd/mm/yyyy), email address and telephone number, including area code (each hereinafter referred to as a “No Purchase Entry”). Send your Entry in a #10 business size envelope with first class postage to: 176 rue du pont, saint-lambert de lauzon G0s2w0 Quebec. Your shipping envelope must include a valid return address, including a full first and last name. No-purchase Entries received without a verifiable and legible return address will be considered incomplete and invalid. Limit one Entry per shipping envelope. Bulk shipments (multiple Entries in a single package) will not be accepted. The No-Purchase Entry, including the shipping envelope, must be handwritten. No mechanically reproduced or mechanically stamped Entries will be accepted. Entries that are shipped on the giveaway End Date, and received by August 16, 2024 will be eligible for the Contest. Each No-Purchase Entry will count as sixty (60) Entries, provided that the No-Purchase Entry meets the requirements set forth above.


Purchase Entries and No-Purchase Entries are each hereinafter and hereinafter referred to as an “Entry” and collectively, the “Entries”.

No-purchase Entries which are not in the format specified above, which are illegible, inaccurate, incomplete or reproduced by photocopier or otherwise will be considered null and void. Proof of submission does not constitute proof of receipt. The Competition Organizer is not responsible for lost, late, illegible, altered, misdirected, insufficiently postage-paid or not received Entries before the deadline. All material submitted becomes the property of the Competition Organizer and will not be returned. No correspondence will be acknowledged or initiated; requests to confirm receipt of Entries without purchase will not be recognized.

PRIZE − Only one (1) Prize corresponding to:

All with an approximate total value of forty thousand dollars $40,000 (hereinafter and hereinafter collectively referred to as the “Prize”).

The Prize consists only of those items specifically listed as part of the Prize. The winner will be solely responsible for all federal, state and local taxes, as well as all fees and expenses related to acceptance of the Prize not specified herein as assumed by the Contest Organizer, including, but not limited to limit, license, insurance, title and registration fees, costs incurred by winner related to acceptance, pickup/delivery or use of the Prize, gas and maintenance of the vehicle, as well as all other costs related to the acceptance and use of the Prize, including, but not limited to, change of transportation, incidental costs, tariffs or duties, service charges, or costs and expenses associated with travel necessary to collect the Prize. The winner must agree to collect the Prize at a location specified by the Contest Organizer in Saint-Gilles, province of Quebec, within thirty (30) days following notification of availability from the Contest Organizer; failure to take delivery within thirty (30) days of availability may result in forfeiture of the Prize and its award to a replacement winner. The winner will be responsible for all aspects of the operation of the awarded vehicle. The winner must have a valid driver's license permitting the operation of the awarded vehicle in the winner's province of residence, as well as proof of legally required insurance prior to delivery, and may be required to provide proof of such documents, before being confirmed as a winner.

In the event that the winner is unable to take delivery of the Prize, or is deemed ineligible for any reason, the winner will be disqualified and a replacement winner may be selected.

The Prize must be accepted as described in these Rules and may not be substituted, assigned, assigned, sold or exchanged for cash, subject to the following. PRIZE AWARDING AND DRAWING − A random drawing to select one (1) winner will be conducted on August 18th at approximately 12:00 p.m. EST, from among all eligible Purchase Entries and No-Purchase Entries received. The draw will be carried out by a representative of the Competition Organizer. The odds of winning the Prize depend solely on the number of eligible Entries received.

HOW TO CLAIM THE PRIZE − The potential winner will be contacted by email and/or telephone and must complete and return an affidavit of eligibility, a release of liability, a Prize acceptance form, as well as a publicity form, in more than one copy of his valid driver's license. In addition, the potential winner must also correctly answer a mandatory mathematical skill-testing question, administered by email or telephone, before receiving the Prize (without any assistance of any kind, mechanical or otherwise) (hereinafter collectively the “Declaration Forms”). Failure to return the required Declaration Forms or respond to a notification within the specified time period, or return of any Prize/Prize notification as undeliverable, will result in disqualification without further notice and a replacement winner will be selected. In the event of disqualification of a potential winner found to be ineligible, not complying with the Rules or unable to claim the Prize as specified, the potential winner will be disqualified and a replacement winner will be selected. The awarding of the Prize is conditional on verification of eligibility and completion by the potential winner of all required Declaration Forms.

GENERAL CONDITIONS

Limitation of liability and release - Non-delivery of the Prize − The Competition Organizer is not responsible for any delay or cancellation of delivery of the Prize due to unforeseen circumstances or circumstances beyond the control of the Competition Organizer. If the manufacturer and/or merchant cancels the order for reasons beyond the control of the Competition Organizer, and the Prize cannot be delivered, no additional compensation will be provided, or if a substitute Prize is provided, the difference in value between the Substitute Price and the Advertised Price will not be provided in cash. The winner acknowledges that the Competition Organizer has not made, nor is in any way responsible for, any warranty, representation or guarantee, express or implied, in fact or in law, relating to any component of the Prize offered in this Competition, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose, and the awarded vehicle may not meet safety or emissions testing required in some provinces and/or municipalities. The winner is responsible for verifying the applicable emissions requirements and safety inspection requirements of his or her province and/or municipality before accepting the Prize and must use the Prize in accordance with these regulations.

Limitation of liability and release - Participation in the Competition and/or the Prize − Participants/winners agree to release, hold harmless and indemnify the Competition Organizer and the Competition Entities, and their respective subsidiaries, parent companies, affiliated companies , advertising and promotion partners, Internet agencies, and each of their respective officers, directors and agents, successors and assigns from any claim or cause of action or liability for any type of loss or damage of any kind arising in full or in part, directly or indirectly, from Participation in the Competition, or acceptance/receipt/movement to and/or from the place of collection of the Prize, use, misuse, acceptance, receipt or possession of the Prize, use of any photo, video and/or entry related to the Contest, or any claim based on rights of publicity, defamation or invasion of privacy. The Contest Organizer and the Contest Entities are not responsible if the Contest cannot be administered or conducted as planned and/or if no Prize can be awarded due to cancellations, delays or interruptions resulting or arising from force majeure, war or terrorism, civil riots, strikes, supply shortages, natural disasters, weather conditions, pandemics, epidemics, compliance with any law or order of an authority government, or any other similar act, event or occurrence reasonably beyond the control of the Competition Organizer. By participating in this Contest, participants agree that the Contest Organizer and the Contest Entities will not be liable for any type of injury, damage or loss of any kind, including, but not limited to, direct damages, indirect, incidental, consequential or punitive to persons or property resulting from access to and use of any website associated with the Contest or from downloading or printing any material downloaded from such website. In the event of any discrepancy or inconsistency between the disclosures or other statements contained in any promotional materials and these Rules, the Rules will prevail, govern and apply. The Contest Organizer and the Contest Entities are not responsible for any errors or omissions in the printing of materials or advertising related to the Contest, in the administration of the Contest or in the announcement of the Prize.

Publicity Permission − Acceptance of the Prize constitutes winner's permission and agreement (this agreement will be confirmed in writing upon request) of the right and permission for the Contest Organizer and the Contest Entities to print, publish, distribute and use, throughout the world and at any time or period, the winner's name and/or likeness, entry, photo, voice, likeness, opinions and information winner's biographical information (including, but not limited to, city of origin and province), Prize information, statements attributable to the winner, and any other information about the winner for advertising, commercial and promotional purposes ( including, but not limited to, announcing one's name on television or radio), for advertising and commercial purposes without additional consideration, compensation, permission or notification, publication in a winners list or list to be used by the Competition Organizer and Competition Entities to re-target participants.

The rights to any video, audio and/or photos of the Prize award ceremony belong solely to the Competition Organizer and may be used in any media worldwide indefinitely and in any manner at the sole discretion of the Organizer of the Contest, without review, notification, approval, consideration or additional compensation to the winner or any third party.

Notice – Damage to Website − The Contest Organizer and the Contest Entities are not responsible for defective, incorrect, undeliverable or incorrectly transcribed telephone/email/Internet transmissions, incorrect announcements of any kind, technical hardware failures or software of any kind, including, but not limited to, any damage to a person's computer related to or resulting from their Participation or experience of any material in connection with the Contest, lost network connections or unavailable, or incorrect, incomplete, garbled or delayed computer transmissions may limit a user's ability to participate in the Contest. The Competition Organizer and the Competition Entities assume no responsibility for undeliverable emails resulting from any form of active or passive filtering by the user's Internet service provider and/or email provider, or for insufficient space in the user's email account to receive emails.

Notice – Social Media − When the Rules allow the use of social media such as Facebook, Twitter or any other social network to participate, participants are informed that the social media and each of its managers and agents assume no responsibility, whatever whatever it may be, in connection with the holding of the Competition. However, when participating via social media, all rules governing its use apply.

Forms − All Registration Forms, Participation Forms and Declaration Forms received become the property of the Competition Organizer and will under no circumstances be returned to the sender and/or participant.

Cancellation/Modification − The Contest Organizer reserves the right to cancel or suspend the Contest at its sole discretion, for any reason, including without limitation, if a virus, bug or other any other factor beyond its control contravenes the security or proper administration of the Competition.

The Competition Organizer reserves the right to modify the Rules or terminate the Competition at any time without incurring liability in any way towards any participant. Any changes to the Rules will be published on the Website. Without limiting the foregoing, the Competition Organizer reserves the right to adjust, without notice, the dates and/or deadlines mentioned in these regulations, when necessary, following technical or other problems. , or in light of any other circumstance which, in the opinion of the Competition Organizer, in its sole discretion, affects the proper administration of the Competition as contemplated in these Competition Rules, or for any other reason. Failure by the Competition Organizer to comply with any provision hereof due to a factor beyond its control will not be considered a violation of these Rules.

Identity of the participant − In the event of a dispute over the identity of the participant, the Entry will be deemed to have been made by the person whose name appears on the online order or on the Registration Form or on the Entry without purchase. Any damage caused to the Website by an entrant will be the responsibility of the entrant and/or the authorized e-mail account holder at the e-mail address submitted at the time of Entry. Proof of submission of Entries will not be considered proof of receipt by the Competition Organizer. The selected winner will be required to provide proof of identity, including a driver's license and/or other photo identification.

Fraud − All Entries suspected of fraud (including, but not limited to, those using robotic, automatic, programmed or similar Entry methods) will be disqualified, at the sole discretion of the Contest Organizer. The Competition Organizer reserves the right to prohibit a person's Participation in the event of suspicion of fraud or manipulation, or if the person does not comply with any of the Participation requirements set out herein or any provision of these Regulations.

The Contest Organizer reserves the right to deny a participant the right to participate in the Contest or win the Prize if it determines, in its sole discretion, that the participant has attempted to undermine the proper functioning of the Contest by cheating, hacking, deception or other unfair practices (including the use of rapid automatic entry programs) or has attempted to annoy, abuse, threaten or harass other participants, the Competition Organizer. The Competition Organizer reserves the right to exclude any participant who does not comply with these Rules or who refuses to participate in any investigation or investigation concerning a lack of compliance. Any attempt by a participant or any other person to deliberately damage a website or undermine the proper running of the Contest, including any fraudulent claim, may constitute a violation of criminal and civil laws. Authorization – Personal Information − The Competition Organizer and the Competition Entities and their authorized agents will collect, use and disclose the personal information you provide during your Participation in the Competition for the purposes of administering the Competition and fulfilling the Prize . By participating in this Competition, the participant consents to the collection, use and disclosure of his or her personal information. Information collected from participants, including, but not limited to, the participant, is subject to the Contest Organizer's Privacy Policy, available on the Website (at ldtgiveaway.ca) (hereinafter referred to as the "Privacy Policy").

Applicable Laws − This Contest is subject to all federal and provincial laws in the province of Quebec. Any legal action must be submitted to the courts having jurisdiction in the district of Quebec, to the exclusion of any other district. All questions concerning the drafting, validity, interpretation and enforceability of these Rules, or the rights and obligations of participants or the Competition Organizer or Competition Entities in relation to the Competition, will be governed by the laws of the province of Quebec, without giving effect to any choice of law or conflict of law rule that would cause the application of the laws of any jurisdiction other than the province of Quebec.

Forfeiture of Prize − If a selected entrant is found to be ineligible, does not accept the Prize, incorrectly answers the mathematical skill-testing question, does not accept or fails to complete and return the Declaration Form or if the Prize is returned because the recipient cannot be found, the selected participant will be deemed to have forfeited the Prize. The Competition Organizer may then, at its sole discretion, randomly select another winner.

Severability of paragraphs − If any clause or paragraph of the Regulations is declared or found to be illegal, unenforceable or void by a competent court, then that clause or paragraph, as the case may be, will be considered void, but all other clauses and paragraphs which are not affected will be applied to the extent permitted by law.

Name of Winner and Rules − The name of the Prize winner will be published on the Website and/or on social media of the Contest Organizer on or about August 22, 2024 or after verification of the Prize winner. The Rules will be published on the Website throughout the Competition Period.
